1. Terms and Conditions
South Coast Holidays Terms and Conditions apply to all bookings. By proceeding with payment, you confirm your acceptance of these Terms and Conditions on behalf of yourself and all other guests staying at the property. Please ensure the Terms and Conditions are shared with all guests staying at the property.
2. Tariffs & Payment
a) Payment of the rental deposit constitutes the guest’s acceptance of these Booking Conditions.
b) The 50% deposit, which includes the booking fee, is required at the time of making the booking.
c) If a deposit is not paid by the due date, your booking is subject to cancellation.
d) A 2.2% Credit Card fee will apply to credit card transactions.
e) Balance of rental must be paid 14 days before occupancy.
f) Bookings are subject to change without notice.
While every effort is made to honour confirmed reservations, management reserves the right to amend, relocate, or cancel a booking if circumstances beyond our control arise. This may include, but is not limited to, property maintenance issues, unforeseen damage, safety concerns, force majeure events, or administrative errors.
In the unlikely event that changes are required, guests will be notified as soon as possible. Where applicable, we will endeavour to offer alternative accommodation of a similar standard or provide a refund in accordance with our cancellation policy. We are not liable for any additional costs incurred as a result of such changes.
3. Security Deposits
a) Security bond of up to $500.00 applies; however, please note that some properties may require a higher bond amount (This is clearly stated at the time of booking).
A valid credit card (Visa or Mastercard only – debit cards are not accepted) must be provided. Please note that we accept valid Visa or Mastercard credit cards only. Debit cards are not accepted. AMEX cards are not accepted.
The security bond will be processed on your credit card prior to arrival and will be released after your departure, provided the property has been left in good condition and all terms have been met.
Credit card details, along with a copy of a driver’s licence, will be securely held on file until the property has been vacated and a post-departure inspection has been completed.
All personal and payment information is stored securely within our encrypted property management system, which is PCI compliant and designed to protect sensitive data. Access to this information is strictly limited to authorised personnel only. Once the inspection has been finalised and no issues are identified, the security bond will be released, and your details will be handled in accordance with our privacy and data protection policies.
b) If no damage has occurred, or no extra cleaning is required, bond money will be refunded to your nominated bank account, and credit card details will be destroyed within two weeks.
c) An increased security bond may be required for long-term or group bookings at our discretion
4. Arrival/departure times
a) Check-in is at 3:00 PM
b) Premises must be vacated by 10a.m otherwise, a $50.00 late fee will apply.
This is unless early check-in or late check-out has been approved by South Coast Holidays
5. Guest Responsibilities
a) Guests are granted a limited permission to occupy the Property for holiday purposes only
b) This is not a residential tenancy agreement under the residential tenancy legislation
c) All guests must comply with the requirements of the Code of Conduct for the Short-term Rental Accommodation Industry (NSW) and conduct themselves in a manner that does not cause nuisance, annoyance, or disturbance to neighbouring properties or other occupants. This includes, but is not limited to, excessive noise and offensive or disruptive behaviour.
Noise must always be kept to a reasonable level, particularly between 10:00 pm and 8:00 am, and must not be audible beyond the property boundary in a manner that disturbs neighbours. For the purposes of this agreement, noise disturbance includes loud music, shouting, intrusive or abusive behaviour, or any other activity that interferes with the quiet enjoyment of surrounding premises.
If a complaint is received, guests will be required to immediately rectify the issue. Continued or serious breaches may result in termination of the booking, eviction from the property, and forfeiture of unused accommodation fees in accordance with NSW legislation.
If management, security personnel, or police are required to attend the property in response to a substantiated complaint, a call out fee of $200 may be charged to cover associated costs.
d) The number of persons occupying the premises is restricted to the number of people for which the property is advertised. (Extra guests are not permitted and WILL BE EVICTED, as will those who are booked to stay.) Breaching this condition will lead to additional charges.
e) Strictly no caravans or tents are permitted on the property
f) Guests and Visitors must comply with parking regulations and always show consideration to neighbours
g) No liability is accepted for any injury, debt, damage, loss, delay, expense, or inconvenience caused directly or indirectly by events beyond the agent's or owner's control. No responsibility is taken for guests’ property left on or near the premises. It is recommended that guests take out personal property insurance or adequate travel insurance, should any unexpected situation arise before or during your travel period. Ensure that the property is always locked when you are not in attendance, including when vacating.
h) Should a guest lock themselves out of the property or misplace keys, a minimum $100 call out fee is applicable. If there is no agent available afterhours, you will have to contact a locksmith and pay them directly for the service at your own cost; there will be no reimbursement for this.
i) GAS BOTTLE REFILL – Please do not leave the BBQ gas bottle empty on departure. If it runs out while using it, please contact our office to receive a voucher. If this occurs after hours, please keep your receipt of refill to be reimbursed by the office.
j) Guests are not permitted to charge electric cars at the properties.
Fees will be applicable.
6. Condition of premises
a) The premises are provided on the condition that guests comply with the Code of Conduct for the Short-term Rental Accommodation Industry (NSW) and take reasonable care of the property.
The property must be left in a reasonably clean and tidy condition upon departure, consistent with its condition on arrival (fair wear and tear excepted). All rubbish must be placed in the appropriate external bins, and bins must be left out for scheduled collection prior to departure. If your stay includes the scheduled bin night, the bins must be placed on the kerb for collection in accordance with local council requirements.
Where the property is left in an unreasonable or excessively untidy condition, additional cleaning charges will apply at a rate of $88 per hour (GST Inclusive), in accordance with the booking agreement and the NSW Short-term Rental Accommodation Code of Conduct.
b) Charges apply for disposal of excess rubbish left at the property at $88 per hour (GST inclusive) plus tip fees.
c) BBQ’s must be cleaned prior to vacating; a fee of $55 (GST inclusive) will be charged if this has not been done.
d) SMOKING – ALL PROPERTIES ARE SMOKE-FREE ZONES INSIDE THE PROPERTY. There will be an extra cleaning charge at $88 per hour (GST inclusive), plus the purchase of products required, for any deodorising if a guest smokes inside a property.
e) Cigarette butts discarded into garden beds may incur an additional charge
f) We hope you catch plenty of fish, but please clean them at the boat ramps, NOT at the premises.
g) Furniture should not be moved around. If furniture is not placed in its original position upon departure, a fee will apply.
7. Cancellations
a) Full refund for cancellations made 30 days or more prior to the arrival date.
Cancellations made between 30 and 14 days prior to the scheduled arrival date will incur a cancellation fee equivalent to 50% of the total booking value.
Accordingly, 50% of the full reservation amount will be retained, and any remaining funds paid above this amount will be refunded in line with our cancellation policy. Cancellations made within 14 days of arrival will incur a 100% cancellation fee (full booking amount payable).
* Please note that the above cancellation terms exclude any applicable credit card processing fees.
8. Linen
a) Linen is supplied for most properties except the following:
– Manyana Beach Escape
– Lago
– Blackfish
b) Additional cleaning fees may be charged where laundering of doonas and mattress protectors is required, in accordance with the actual and reasonable cleaning costs permitted under the Fair-Trading Amendment (Short-term Rental Accommodation) Act 2018 and the associated Short-term Rental Accommodation Code of Conduct.
9. Pets
a) NO PETS are allowed on the premises unless the property is advertised as pet-friendly or you have been given approval with written confirmation.
b) If the property does allow dogs, it is OUTSIDE ONLY, unless express permission is given by one of our agents in writing.
c) You are required to pick up all dog droppings from the garden and yard, or charges will apply.
d) You will be charged $88 per hour (GST inclusive) for cleaning if dog hair is found in the house, on any furniture and or on beds.
10. Faults & problems
a) Under the NSW Code of Conduct for Short Term Rental Accommodation, guests are required to notify the host or managing agent of any issues as soon as possible after they arise. While the legislation does not prescribe a specific number of hours, prompt reporting is necessary to allow the host or agent a reasonable opportunity to investigate and resolve the matter.
Accordingly, guests must report any concerns or issues to our office within 12 hours of arrival. This timeframe is considered reasonable and ensures we have the opportunity to address the matter during the stay.
Failure to notify us within these 12 hours may limit or prevent any entitlement to compensation, particularly where delayed reporting removes the opportunity to rectify the issue.
b) Any breakages, damage or lost keys must be reported as soon as possible and paid for. If any repairs are needed, South Coast Holidays should be notified immediately. The guest agrees to allow the agent or their nominee to enter the premises to arrange necessary repairs.
In the event of faults and/or malfunctions of inclusions, there is no obligation from the owner or South Coast Holidays to compensate or discount.
c) South Coast Holidays will not be held responsible for any inconvenience caused by the breakdown or failure of appliances, equipment, or services within the property. In the event of a malfunction, the agent will make every reasonable effort to arrange repairs, replacement, or provide a suitable alternative as soon as possible.
11. Properties for sale
a) When a booking is made, the deposit is accepted by the owner at the time. If the property is put on the market for sale before your stay and the ownership changes, we cannot guarantee that the property will remain available. A full refund will be provided if this is the case.
b) We cannot accept responsibility for decisions made by the owner
c) If a property is sold, guests will be notified, and we will endeavour to organise alternative accommodation
12. Disclaimer
a) South Coast Holidays operates in accordance with the Code of Conduct for the Short-term Rental Accommodation Industry (NSW).
By confirming this booking, you acknowledge and agree that if you, or any guest or visitor associated with your booking, breach the Terms and Conditions of stay or the NSW Short-term Rental Accommodation Code of Conduct, your name and contact details (including phone number and email address), together with details of the breach, may be recorded and disclosed to the property owner and/or relevant industry participants, including for the purposes permitted under the Code.
South Coast Holidays reserves the right to refuse or cancel a booking where a guest is listed on the NSW Short-term Rental Accommodation exclusion register or has been identified as non-compliant under the Code, in accordance with applicable legislation.
b) All properties are described as accurately as possible and are all spoken about in good faith. No responsibility is taken for any errors, omissions or misdescriptions.
